Help for Injured Family Motor Coach Association Members Visiting Minot for the Annual Convention and Expo

The Family Motor Coach Association’s (FMCA) 100th International Convention & RV Expo will be held from August 14th through August 17th this year. The “Minot Magic” convention is expected to draw thousands of members and non-members alike.

This year’s convention will be held at the North Dakota State Fairgrounds to accommodate all of the vendors and attendees. The Fairgrounds are a state facility; therefore, if you suffer some kind of injury as a result of the Fairgrounds’ negligence, you have 180 days to file a notice with the state of North Dakota. Otherwise, you will forfeit your right to bring a claim at all. After that, you have three years to file a lawsuit.

Negligence at the North Dakota State Fairgrounds

Anytime thousands of people are in a space, there is a chance someone could get hurt. The state of North Dakota, however, can only be held liable if its own negligence, or the negligence of the North Dakota State Fair Association, played a role in your injuries.

The state is responsible for keeping the following areas safe:

  • The State Fair Center, including but not limited to:
    • Arenas
    • The theater
    • The 4-H hall
    • The FFA Hall
    • The Magic Place
    • Its support rooms
  • The Fairgrounds themselves, including but not limited to:
    • Areas
    • Parking lots
    • All stages
    • All barns
    • The food court and restaurant
    • The racetrack
    • All tents

These areas must be safe and secure not only for visitors and vendors, but also for employees. Examples of negligence that could lead to injury can include:

  • Unlit parking lots
  • Broken stairs, elevators, and escalators
  • Broken or defective handrails
  • Faulty or damaged electrical and gas lines
  • Falling objects, such as stage lights or tent failures
  • Lack of warnings for wet floors or unsafe areas to walk
  • Broken pathways, walkways, and sidewalks
  • Negligent hiring practices, including failing to perform background checks on employees
