Larson Law’s Year in Review: 2023
Last year was busy for Larson Law. We’re proud to say we helped a lot of folks and secured some significant settlements on their behalf. All told, we obtained more than $3.7 million for people across North Dakota.
One of the benefits of having served this community for 45 years is that our firm is equipped to handle any injury case that comes our way. The cases we handled and the folks we helped were all very different, and we wanted to share some of those cases – and their results – with you today.
A dram shop case against three different bars in Velva, ND: $2.5 million
This case involved a drunk gentleman who ran over several people at a bar. At the conclusion of the case, we were able to obtain a $2.5 million dollar judgment against one of the bars, and obtained other, smaller judgments against the two other bars, as well as a recovery from the automobile insurer of at least 100k. Attorneys Shelby Larson and Mark V. Larson worked this case to a conclusion.
Acting as local counsel in Davis, et al. v. Mercy Medical Center, et al.: $1.8 million
This justice was a long time coming. Back in 2018, Michael Davis successfully sued Mercy Medical Center d/b/a CHI St. Alexius Health Williston for medical malpractice. The defendants appealed. Our firm acted as local counsel in the case on behalf of Michael Davis and his wife, Kimberly. The case made it to the Supreme Court of North Dakota, which affirmed the judgment of over $1.8 million dollars.
A case on behalf of a farmer who was injured by his brother: $1.5 million
Our client was injured while helping his brother on the farm. Although the initial insurance company offers were significantly less, the ultimate settlement was for policy limits. We also helped our client obtain additional medical care, as well as cover his needs in assisted living for the next several years, through a structured settlement.
A bad faith claim against our client’s own insurance company: $150,000
Our client made a claim against his own auto insurance company, and that company acted in bad faith. (We told you these companies aren’t your friends.) We sued the insurance company for bad faith, and the final offer exceeded the initial offer by over five times. The final payment was roughly $150K.
A confidential settlement for a victim of chiropractic negligence
Our firm also obtained a settlement against a chiropractor for chiropractic negligence. The settlement was not disclosed, but it was in the high five-figure range.
A confidential settlement against Burlington Northern Sante Fe Railroad (BNSF)
We also brought a property claim against the Burlington Northern Sante Fe Railroad (BNSF) for damages to our client’s property when BNSF trespassed on their land. This matter was settled after mediation. After we rejected the final claims, BNSF met our demand in the high five-figure range.
Other significant settlements over the year include:
- $400,000 as a result of an automobile accident in Dickinson, ND where our client was rear-ended by a car repair shop worker who was testing a vehicle with bad brakes.
- $100,000 for a broken leg following a slip and fall at an automobile dealership.
- Approximately $60,000 for a dog bite.
We chose these awards to discuss because we think they’re a good representative of the types of cases we take. From slip and fall and dog bites, to car accidents, to medical malpractice, and even appeals at the State’s highest court – we do whatever it takes to help people.
